The Supreme Court of the United States has recognized that students do not relinquish their First Amendment rights to free speech and expression upon entering the schoolhouse doors. Yet, due to the peculiar setting of the school environment, the Supreme Court has recognized that some restrictions may be necessary to maintain the safety and integrity of the learning environment, thus limiting the rights of students within the school context. In its rulings, the Supreme Court of the United States recognizes that the school environment is, and should be, a “marketplace of ideas”. First Amendment protections are instrumental in maintaining that marketplace. Students, as citizens, are protected in the exercise of their freedom of speech, press, religion, assembly and to petition the government.
